Silver Streak Senior Services LLC

Effective September 16, 2026 | Vendor / Partner relationship only


Scope. These provisions govern Silver Streak business Partners and vendor advertising relationships only. Member terms and member dispute provisions are maintained separately and are not incorporated into this document.

Operating principle. Partners may leave without artificial barriers. Paid service remains available through the applicable paid period when a Partner voluntarily cancels in good standing. When Silver Streak terminates a relationship and stops providing prepaid recurring service, unused prepaid recurring service is handled under Section 4.5.

1. Voluntary Cancellation by the Partner

1.1 Voluntary Cancellation

A Partner may cancel its recurring subscription at any time. Cancellation stops future renewal charges and becomes effective at the end of the then-current paid billing period. The Partner's listing, dashboard access, placements, and applicable benefits remain available through the end of that paid period, provided the Partner remains in good standing and is not suspended or terminated under Section 4. Fees already paid for the current billing period are not prorated or refunded except as expressly provided during an applicable refund period or as required by law.

1.2 How to Cancel

A Partner may cancel through the Partner dashboard or by another cancellation method made available by Silver Streak. No advance notice period is required. Cancellation, plan changes, and additions or removals of ZIP codes ordinarily become effective at the beginning of the next billing period unless otherwise expressly stated.

1.3 Annual Packages

An annual package is prepaid for the full annual term. Cancellation outside an applicable refund period stops the package from renewing at the end of that annual term but does not ordinarily terminate the current prepaid annual term. The Partner's listing, dashboard access, placements, and applicable benefits remain available through the end of the prepaid annual term, provided the Partner remains in good standing and is not suspended or terminated under Section 4.

2. Annual Prepaid Package Refunds

2.1 Fourteen-Day Change-of-Mind Period

A Partner purchasing an annual prepaid package may cancel within fourteen (14) days after the Publication Date and receive a refund calculated under this Section. For purposes of these Terms, “Publication Date” means the date the Partner's listing is first published and made publicly available on the Silver Streak platform. The fourteen-day period applies only to annual prepaid Partner packages and does not apply to monthly recurring Partner packages.

A Partner's enrollment or payment does not reserve a ZIP code, sponsorship, category position, feature week, or other capacity-limited placement before the Partner selects the placement and Silver Streak confirms it. Delay by the Partner in completing information required for publication does not prevent another eligible business from selecting or purchasing an otherwise available placement.

2.2 Promotional Benefits and Services

Annual packages may include promotional benefits, complimentary services, advertising, content, placements, features, or other benefits made available because of the Partner's annual commitment. The applicable value of each such benefit is the value disclosed to the Partner in the package description, order page, enrollment flow, or other offer in effect at the time of purchase. Silver Streak may change package pricing or stated values prospectively, but a later change does not alter the values applicable to an earlier purchase.

Where a refund is available, Silver Streak may deduct the applicable disclosed value of promotional benefits or services already provided, performed, delivered, or used by the Partner. No deduction will be made for a promotional benefit or service that was neither provided nor used.

2.3 Examples of Deductible Benefits

Subject to the disclosures applicable at the time of purchase, deductible amounts may include onboarding or verification services already completed; Done-For-You advertising or listing-build services already completed or published; Partner articles, interviews, promotional content, or other content already created or published; sponsorship periods already provided; ZIP-code or premium-placement periods already provided; and other promotional benefits or services already delivered or used.

Deductions will not exceed the amount otherwise refundable and will not create an additional amount owed by the Partner unless a separate legal obligation exists.

2.4 Internal Business Costs

Silver Streak may incur internal costs in acquiring, onboarding, servicing, or supporting a Partner, including sales commissions, payment-processing expenses, administrative costs, staffing costs, and other business expenses. Unless a particular charge is separately disclosed to and agreed to by the Partner and is permitted by applicable law, such internal business expenses are not independently deducted from a Partner refund merely because Silver Streak incurred them.

3. Non-Payment

3.1 Notice and Opportunity to Resolve

If a scheduled payment fails, Silver Streak will notify the Partner and provide an opportunity to resolve the failed payment. Silver Streak may provide notices by email, dashboard notification, SMS where authorized, or another contact method associated with the Partner's account. During the applicable resolution period, the Partner's listing and placements may remain active, and Silver Streak may offer alternatives including a different package, extension, or other payment arrangement.

3.2 Automatic Pause

If payment remains unresolved after the applicable resolution period, the account may be paused automatically. Upon pause, the listing may be removed from public display, dashboard access and Partner resources may be disabled, recurring charges stop, and placements are released under Section 5. Payment of an outstanding amount may restore account eligibility, but does not guarantee restoration of any placement released during the pause.

3.3 No Continuing Charges

A paused account does not accrue recurring charges for service periods following the pause. Silver Streak does not pursue amounts corresponding to recurring service that Silver Streak did not provide after the account was paused.

3.4 Release Is Not a Forfeiture

ZIP codes, sponsorships, feature weeks, category positions, and similar placements are conditional contractual rights associated with an active account and are not owned property of the Partner. When the conditions necessary to hold a placement cease to exist, the placement becomes available for allocation to another Partner.

4. Suspension and Termination by Silver Streak

4.1 Grounds

Silver Streak may suspend or terminate a Partner's participation when, in Silver Streak's reasonable judgment, circumstances present a material trust, safety, legal, compliance, credentialing, reputational, or platform-integrity concern. Grounds may include, without limitation:

  • fraud or suspected financial exploitation;
  • abuse, neglect, violence, threats, or conduct creating a material safety concern;
  • materially false, misleading, incomplete, expired, or unverifiable licensing, credentialing, insurance, or business information;
  • deceptive or materially misleading business practices;
  • misuse of Silver Streak branding or trust indicators;
  • unlawful discrimination;
  • material violation of applicable law;
  • material violation of these Terms or the Vendor & Advertiser Participation Agreement; or
  • other conduct that reasonably presents a material risk of harm to seniors, families, Partners, Silver Streak, or the public.

Silver Streak may act immediately where continued public display or access would reasonably present a material safety, fraud, legal, or trust risk.

4.2 Suspension

Suspension is an interim protective measure used while a concern is investigated, verified, corrected, or otherwise resolved. During suspension, Silver Streak may remove the Partner from public display, disable dashboard access, stop recurring billing, and release placements. Suspension does not reserve the Partner's prior ZIP code, sponsorship, category position, feature week, or other placement.

4.3 Termination

Termination permanently ends the Partner relationship. Upon termination, public display and Partner access end, future recurring charges stop, and all placements are immediately released.

4.4 Reinstatement

Where the circumstances giving rise to a suspension are resolved and the Partner continues to satisfy Silver Streak's participation requirements, Silver Streak may consider reinstatement. Reinstatement is not guaranteed and does not restore a previously released placement. Any reinstated Partner is subject to then-current eligibility, verification, pricing, package, capacity, and placement requirements.

4.5 Refund Following Termination by Silver Streak

Where Silver Streak terminates a Partner and the Partner has prepaid for recurring service that will not be provided following the effective termination date, Silver Streak will refund the unused prepaid recurring-service amount, less:

  • amounts attributable to service periods already provided;
  • the applicable disclosed value of promotional benefits or services already provided or used under Section 2;
  • separately identified non-refundable fees that have been earned or for which the applicable service has already been performed; and
  • any other amount Silver Streak is lawfully entitled to retain.

Deductions will not exceed the amount otherwise refundable and will not create an additional debt owed by the Partner unless a separate legal obligation exists.

Nothing in this provision requires Silver Streak to refund an amount that applicable law permits Silver Streak to retain because of fraud, chargeback abuse, unlawful conduct, amounts previously refunded or credited, or other circumstances expressly permitted under these Terms or applicable law.

Unless a shorter period is required by applicable law, Silver Streak will process any refund due under this Section within thirty (30) days after the refund amount can reasonably be determined.

4.6 No Continued Consumption of Prepaid Service Following Termination

Once termination becomes effective and Silver Streak has ceased providing the Partner's recurring services, Silver Streak will not continue consuming the Partner's prepaid recurring-service period merely because time remained in that billing period. The unused prepaid recurring-service amount will instead be handled under Section 4.5.

5. Placements: ZIP Codes, Sponsorships, Category Positions, and Feature Weeks

5.1 Conditional Rights

Reserved ZIP codes, state sponsorships, category positions, front-page feature weeks, premium placements, exclusivity arrangements, and similar inventory are made available subject to the Partner maintaining the eligibility and account status required for that placement. A placement is a limited, conditional, non-transferable contractual right or license to appear. It is not property owned by the Partner and may not be sold, assigned, transferred, or sublicensed.

Because placement inventory may be capacity-limited, allocation of a placement to one Partner may prevent Silver Streak from offering that same placement to another Partner during the applicable period.

5.2 Selection and Reservation of Placements

Enrollment, payment, account creation, or an unpublished draft listing does not by itself reserve a ZIP code, sponsorship, category position, feature week, or other capacity-limited placement. A placement is reserved only after the Partner selects the placement and Silver Streak confirms the reservation through the platform or another authorized method. Availability is determined at the time of confirmed selection. If another eligible business selects or purchases an available placement before the Partner completes its selection, the earlier confirmed selection controls.

5.3 Release of Placements

For a Partner who voluntarily cancels while remaining in good standing, placements remain available through the paid service period and are released on the effective date of cancellation. Upon expiration, suspension, termination, or automatic pause for non-payment, placements are released into general availability and may be claimed by another eligible business.

5.4 No Guarantee of Future Availability

Silver Streak does not guarantee that a particular ZIP code, sponsorship, category position, feature week, premium position, or other capacity-limited placement will remain available after it has been released. Payment, reinstatement, renewal, or return following a lapse does not entitle a Partner to recover a previously released placement.

6. Waitlist and 72-Hour Claim Window

6.1 Waitlist Status

Where a category or placement has reached capacity, an eligible Partner may be permitted to join a waitlist. Joining a waitlist is free unless expressly stated otherwise and creates no ownership interest, entitlement, reservation, right of first refusal, or guarantee that a position will become available.

6.2 Notification and Claim Period

When a position becomes available, Silver Streak may offer the position to the next eligible Partner on the applicable waitlist. Silver Streak will send notice to the Partner's email address on file and may additionally provide notice through the Partner dashboard and/or SMS where authorized. The Partner has seventy-two (72) hours from transmission of the initial offer notice to claim the position and complete any required payment. Partners are responsible for maintaining accurate and current contact information.

6.3 Expired Offer

If the Partner does not claim the position and complete any required payment within the 72-hour period, the offer expires automatically and Silver Streak may offer the position to another Partner. Expiration of an offer does not constitute suspension, termination, forfeiture, or loss of property. Unless Silver Streak states otherwise, the Partner remains eligible for future waitlist opportunities.

7. Partner Content Following the Relationship

Articles, profiles, interviews, educational materials, promotional content, backlinks, photographs, videos, recordings, or other Partner-related content published through Silver Streak may, following cancellation, expiration, suspension, or termination, be removed, unpublished, archived, retained, or modified to remove Partner promotional references or links, in Silver Streak's discretion, subject to applicable law and any separate written intellectual-property or content agreement.

A benefit consisting of content creation, production, publication, advertising, or promotional work is considered provided when the applicable work has been substantially performed or delivered as specified in the applicable package or offer. Subsequent removal, archiving, modification, or unpublishing of that content does not by itself cause the previously provided benefit to become unused or refundable.

8. Silver Streak Branding and Partner Independence

8.1 Partner Independence

Partners are independent businesses. Silver Streak does not control and does not seek to control a Partner's political, religious, social, civic, or other lawful expression made independently of Silver Streak. Participation in Silver Streak does not require a Partner or its owners, employees, or representatives to adopt Silver Streak's views on matters unrelated to participation in the platform.

8.2 Use of Silver Streak Branding

A Partner may not use the Silver Streak name, trademarks, logos, trust badges, verification indicators, co-branded materials, dual-branded materials, or other Silver Streak branding in a manner that reasonably suggests that Silver Streak sponsors, endorses, supports, or is affiliated with the Partner's political, religious, ideological, or unrelated advocacy.

A Partner remains free to engage in lawful expression in its own name and through its own channels, provided the Partner does not use Silver Streak branding or the Silver Streak relationship to imply Silver Streak's participation in or endorsement of that expression.

8.3 Correction and Misuse of Branding

Where Silver Streak reasonably believes its branding has been used contrary to this Section, Silver Streak may require the Partner to remove, correct, or discontinue the use. Where appropriate, Silver Streak will ordinarily provide the Partner an opportunity to correct the branding issue. Silver Streak may suspend or terminate participation without a correction period where the misuse is repeated, intentional, materially misleading, unlawful, or reasonably presents an immediate material risk to Silver Streak, its members, Partners, reputation, or the public.

9. Cooperation With Law Enforcement and Legal Process

Silver Streak may preserve, review, and disclose Partner account information, listing content, communications transmitted through the platform, and related records when Silver Streak believes in good faith that doing so is reasonably necessary to:

  • comply with valid legal process, including a subpoena, court order, warrant, or other legally enforceable request;
  • enforce these Terms or investigate a suspected material violation;
  • respond to suspected fraud, elder financial exploitation, abuse, threats, or other harm involving a senior or member of the public; or
  • protect the rights, property, safety, or legal interests of Silver Streak, its members, Partners, or the public.

Where legally permitted and where doing so would not compromise an investigation, create a safety concern, or violate a legal obligation, Silver Streak may make reasonable efforts to notify the affected Partner.

10. Governing Law and Dispute Resolution

10.1 Governing Law

These Terms, the Partner relationship, and any dispute, claim, or controversy arising out of or relating to these Terms, the Vendor & Advertiser Participation Agreement, a Partner's subscription, listing, advertising, placement, billing, participation in the Silver Streak platform, or the relationship between the Partner and Silver Streak shall be governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent applicable federal law controls.

10.2 Agreement to Arbitrate

Except for a claim that qualifies for the small-claims exception in Section 10.3, the Partner and Silver Streak Senior Services LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Vendor & Advertiser Participation Agreement, the Partner's subscription, listing, advertising, placement, billing, participation in the Silver Streak platform, or the relationship between the Partner and Silver Streak shall be resolved by binding arbitration rather than by a lawsuit in court.

The arbitration agreement shall be governed by the Federal Arbitration Act to the extent applicable.

Arbitration shall be conducted on an individual basis before a single neutral arbitrator through a nationally recognized arbitration provider mutually agreed upon by the parties. If the parties cannot agree upon a provider, either party may seek appointment of an arbitrator or other appropriate relief from a court of competent jurisdiction.

The arbitrator may award any individual remedy or relief that would otherwise be available to the parties under applicable law and that is within the scope of the claims properly submitted to arbitration.

Judgment upon an arbitration award may be entered and enforced in any court having jurisdiction.

10.3 Small-Claims Exception

Notwithstanding Section 10.2, either Silver Streak or the Partner may bring an individual claim in a small-claims or justice court having jurisdiction over the claim if the claim qualifies for that court and remains on an individual basis.

If such a claim is transferred, removed, appealed, or otherwise proceeds in a manner that causes it no longer to qualify for the small-claims exception, either party may invoke the arbitration requirement in Section 10.2 to the extent permitted by applicable law.

10.4 Class, Collective, and Representative Action Waiver

To the fullest extent permitted by applicable law, the Partner and Silver Streak agree that claims against one another may be brought only in an individual capacity and not as a plaintiff, claimant, class member, or representative in any purported class, collective, consolidated, coordinated, mass, private-attorney-general, or representative proceeding.

The arbitrator shall have authority to resolve only the individual claims between Silver Streak and the Partner and shall not consolidate the claims of multiple parties or preside over any form of class, collective, mass, consolidated, coordinated, or representative proceeding except where applicable law expressly prohibits enforcement of this limitation.

10.5 Attorney's Fees and Costs

Except where applicable law expressly provides otherwise and does not permit the parties to alter that rule by agreement, each party shall bear its own attorney's fees, legal expenses, and other costs incurred in connection with any dispute between the parties.

This provision applies to arbitration and to any subsequent or related judicial proceeding, including proceedings to compel arbitration, enforce or confirm an arbitration award, challenge or vacate an arbitration award, or otherwise enforce these Terms.

Arbitration filing fees, administrative fees, and arbitrator compensation shall be allocated in accordance with the applicable arbitration rules and applicable law.

10.6 Venue for Permitted Court Proceedings

For any dispute or proceeding that is not required to be arbitrated under these Terms, including a qualifying small-claims action or a judicial proceeding concerning the enforcement of an arbitration agreement or award, the parties consent to jurisdiction in the state or federal courts having jurisdiction in or over Collin County, Texas, except where applicable law requires otherwise.

Each party waives any objection based on improper venue or inconvenient forum to the fullest extent permitted by law.

10.7 Two-Year Contractual Limitations Period

To the fullest extent permitted by applicable law, any claim, action, arbitration, or other proceeding arising out of or relating to these Terms, the Vendor & Advertiser Participation Agreement, the Partner's subscription, listing, advertising, placement, billing, participation in the Silver Streak platform, or the relationship between the Partner and Silver Streak must be commenced within two (2) years after the claim or cause of action accrues.

If applicable law prohibits application of the two-year contractual limitations period to a particular claim, the shortest limitations period permitted by applicable law shall apply to that claim.

Nothing in this Section shortens a limitations period where applicable law prohibits the parties from doing so.

10.8 Survival

This Section survives cancellation, expiration, suspension, or termination of the Partner's participation or subscription and continues to govern disputes arising from the Partner relationship.

11. Relationship to Other Vendor Documents

These Vendor Terms are intended to operate together with the Vendor & Advertiser Participation Agreement, Refund & Billing Policy provisions applicable to Partners, the package or offer accepted by the Partner, and any other vendor-specific terms expressly incorporated into the Partner enrollment process. Member-facing terms govern member relationships separately and do not govern a dispute arising from a Partner subscription, listing, placement, advertising purchase, or Partner billing relationship.

Where the same individual also holds a Silver Streak member relationship, the governing terms follow the capacity in which the claim arises: Partner-related claims are governed by the applicable vendor documents, and member-related claims are governed by the applicable member documents.

12. Electronic Acceptance and Contract Record

Electronic acceptance of the applicable vendor documents constitutes the Partner's agreement to be bound by them. Silver Streak may maintain an electronic record of acceptance, including the business legal name, name and title of the person accepting on behalf of the business, email address, date and time of acceptance, and the version or copy of the documents accepted. The Partner represents that the individual accepting has authority to bind the Partner business.
